Resolving Child Custody And Child Support Issues

Issues involving children are some of the most contentious aspects of any family law case. As a parent, you have a desire to sacrifice everything for your children. However, a legal decision must be made that is in the best interests of your child, which may not always align with your initial desires. That is why it is important to seek help from a lawyer who can help provide you with some clarity, identify some realistic goals and who will work toward a solution that protects both your interests and those of your child.

I am attorney Timothy J. Hennessy and I founded my law firm to help people throughout the Buffalo area with their difficult legal issues. I am here to listen to your concerns and to answer any questions you may have at any time.

Types Of Child Custody

There are two main types of child custody. Physical custody refers to where the child will spend most of their time. This is usually granted to only one parent. Legal custody refers to the right of the parent to make decisions on a child’s behalf, such as those involving health care, education and religious upbringing. Legal custody may be granted to either one or both parents.

The courts recognize that a child often benefits from having some form of relationship with both parents and will try to find a way to make this happen, even if that only means occasional visitation periods. I can let you know which factors the court will take into account when making a custody determination and what impact this may have on your case.

Making A Support Determination

In general, child support determinations are pretty straightforward. The state of New York has guidelines in place that can help determine the approximate amount of support you can expect to pay or receive, although there are always exceptions to the rule. Whether you are requesting support or are being asked to make payments, I will help work toward a resolution that gives your child the proper amount of financial support.
